General Terms and Conditions
for Photography, Videography and Web Design Services
by Christoph Held – Foto & Media by Chris


1. Scope of Application
These Terms and Conditions apply to all contracts, offers, services, and deliveries between Christoph Held, owner of Foto & Media by Chris (hereinafter referred to as „Service Provider“), and the client (hereinafter „Client“). This includes services in the fields of photography, videography, and web design. Any differing terms of the Client will not be recognized unless explicitly approved in writing by the Service Provider.

2. Conclusion of Contract
A contract is concluded when the Client accepts an offer from the Service Provider in writing, via email, or verbally, or upon confirmed booking.

3. Scope of Services
(1) The Service Provider commits to professionally and timely deliver the agreed services – photography, videography, or web design.
(2) The specific scope of services is outlined in the respective offer or order confirmation.
(3) Any changes requested after the contract has been signed may incur additional costs and must be agreed upon separately.

4. Fees and Payment Terms
(1) The fees are based on the agreed price in the individual offer.
(2) A deposit of 30% of the total amount may be required upon commissioning.
(3) The remaining balance is due no later than 14 days after delivery of the final services.
(4) For larger web design projects, milestone payments may be arranged.
(5) In the event of late payment, the Service Provider reserves the right to charge reminder fees and default interest.

5. Usage Rights (Photography, Videography, Web Design)
(1) The Service Provider grants the Client a simple, non-transferable right of use for the delivered works – for private or agreed commercial use, depending on the project.
(2) For web design projects, the Client receives the agreed rights of use for the designed website and developed content upon full payment.
(3) The Service Provider retains authorship of all work and may use the results for self-promotion (e.g. portfolio, website, social media), unless the Client expressly objects prior to the contract.
(4) Any transfer of usage rights to third parties requires written consent.

6. Liability
(1) The Service Provider is liable only for intent and gross negligence.
(2) In case of illness, force majeure, or technical failure, the Service Provider is not obligated to fulfill the contract but will strive to provide a suitable alternative or solution.
(3) The Service Provider is not liable for any incompatibility or malfunction of websites on certain devices or browsers unless caused by gross negligence.
(4) Once materials are delivered, the Client is responsible for proper storage and data security.

7. Delivery Time and Handover
(1) The usual delivery time for photo and video services is 2–4 weeks.
(2) Web design projects may take several weeks or months depending on scope; timelines are defined individually.
(3) Delivery is made digitally via download link, cloud storage, or, in the case of web design, by deployment to a server.

8. Client Responsibilities
(1) The Client agrees to provide all necessary content, information, and access required for the performance of services in a timely manner.
(2) For web projects, the Client is responsible for all content (texts, images, legal pages) unless otherwise agreed.
(3) Delays caused by the Client’s failure to cooperate entitle the Service Provider to adjust deadlines accordingly.

9. Data Protection
The Service Provider complies with data protection laws. Personal data of the Client will only be used for contract fulfillment and will not be shared with third parties. Further information can be found in the privacy policy at www.fotomediabychris.com.

10. Cancellation and Withdrawal
(1) The Client may cancel the contract before the start of service.
(2) Cancellations made less than 14 days before the agreed date may be subject to a cancellation fee of up to 50% of the total agreed amount.
(3) Services already provided and costs incurred will be invoiced in any case.
(4) For web design projects, no refund will be issued for work already completed.

11. Final Provisions
(1) German law applies exclusively.
(2) The place of jurisdiction, as far as legally permissible, is the registered business location of Christoph Held.
(3) If any provision of these Terms and Conditions is found to be invalid, the validity of the remaining provisions shall remain unaffected.
